TERMS & CONDITIONS
1. PARTIES
These Terms and Conditions set out the terms of agreement between you  and Koala & Tree Pty. Ltd. ABN 142 365 160 ("Koala Living", “we” “us” or  “our”) of PO BOX 371 Altona North, VIC 3025, Australia.

2. GENERAL
a. These Terms & Conditions form a binding legal agreement between  you and Koala Living in regards to your purchases from Koala Living.

b. Products are suitable for domestic use only, unless otherwise specified.

c. We may modify these Terms & Conditions. The Terms & Conditions  which apply to a purchase are those that are made available to you on  the day of your purchase. If we modify these Terms & Conditions, we  will post a revised version on our website at www.koalaliving.com.au  and make the revised Terms & Conditions available in store.

d. Any provision of these Terms & Conditions which is wholly or partially  void or unenforceable is severed to the extent that it is void or unenforceable. The validity or enforceability of the remainder of the  Terms & Conditions is not affected. 

e. These Terms & Conditions will be governed by and construed in  accordance with the laws of the State or Territory in Australia where the  products are purchased. The parties agree to irrevocably and unconditionally submit to the non-exclusive jurisdiction of the Courts in  the State or Territory in Australia where the products were purchased.


3. PURCHASE POLICY
a. All Koala Living prices displayed on the website are in Australian  currency and include GST. We accept payment by Visa, MasterCard, cash, Koala living voucher and Zip payments. All sale prices during  promotions are shown alongside the Recommended Retail Price (RRP)  for your reference. Prices are subject to change and Koala Living  reserves the right to amend prices without further notifications. Full  payment of the purchase price including delivery fees must be made  prior to delivery.

b. In an effort to keep your payment information secure, we have  collaborated with a global omnichannel payment provider to process  secure credit card payments worldwide. We do not retain your credit  card information after your order is finalised. All sensitive information  concerning financial materials are encrypted. A confirmation of your  purchase order will be sent to you via email. Please ensure that you  provide accurate and up to date contact information should we need to  confirm the security of your order. It is the responsibility of the  customer to ensure all order details are accurate. 

c. Online orders will only be processed after the entire order value  inclusive of GST has been paid in full. Instore orders will only be  processed after the minimum deposit amount has been paid inclusive  of delivery fees and GST.

d. Koala Living will offer price matching during promotional periods  provided that the order has not been delivered or collected and the  invoice purchase date is within 60 days of the promotional period. If the  invoice is paid in full, you will receive a credit note for the difference to  be used on any new invoice. If it is not paid in full, we will reduce the  invoice to match the new price provided you notify us within the time  period mentioned above.

e. The final delivery charge for your order will be calculated at the time of  checkout if purchasing online or at point of purchase when confirming  delivery for an in-store purchase. Delivery charges are calculated  based on multiple factors and may change if your order is amended.

f. Special orders cannot be cancelled or altered once the order is placed  and a termination fee of fifty percent (50%) of the total item value is  applicable. Special order options are not available online as we require  our customers to sign off on custom orders.

g. Koala Living will hold your order up to 12 weeks from product  availability. It is the responsibility of the customer to find an alternative  storage solution thereafter.

h. Prices for products change from time to time due to price hikes and  surcharges in the supply chain and we do not provide any notice of  these changes.

i. All purchase orders must be finalised and paid in full prior to  confirmation of delivery or collection.

j. Unless otherwise stated, Koala Living will not allow discounts to be  entered after an order has been placed and finalised. All promotional  discounts need to be used/entered at point of purchase.

k. Koala living aims for all orders to be shipped and delivered within 1-3 weeks of becoming available. The estimated time of arrival (ETA) of  product(s) is an approximation only and is subject to change. We do try  our utmost best to communicate possible changes when it becomes  available to us.

l. Koala Living Luxe membership is valid for 2 years and is non refundable for cash or credit. Promotions and further discounts in  relation to the membership is at the discretion of Koala Living and may  be withdrawn at any time. 

m. Koala Living credit notes/Vouchers are valid for thirty-six (36) months  after their date of purchase. Any balance remaining after its expiry will  be forfeited and will automatically become the property of Koala Living.  Extensions will not be provided. Credit notes and vouchers are not  redeemable for cash.

n. All quotes are valid for two weeks or until the date stated on the quote.  All quotes must be written and issued on our system to be redeemed. Verbal quotes or quotes that are not on our system or expired are not  valid. If there is no end date stated on the quote, then it is valid until the  end of the promotion that was on when the quote was issued.

o. Koala Living may reject all or any part of your order, or restrict the  quantity of certain goods for the following reasons:
i. A product in that order is discontinued and no longer available;
ii. The shipping fee quoted and payable by Koala Living is seen as  excessive;
iii. We reserve the right to remove item(s) for sale temporarily if  there is an error in the price, product, or the description displayed on the website or instore;
iv. The order triggers fraud prevention protocols;
v. We believe that to do so is otherwise necessary or expedient.

p. Promotional discounts do not apply to third party services and consignment products.

4. CHANGE OF MIND POLICY:
If you have changed your mind on your order, you have the following options:

a. If the balance is not paid in full, you may remove or exchange items from your order up to the value paid initially (deposit amount); however,  the new balance after adjustments may not be reduced to less than the  initial deposit.

b. If you wish to remove items from your order and the balance amount  goes into a negative balance, this deficit amount will be converted to a Store Credit Note and will not be returned to you as a Cash Refund.

c. If the order is paid in full and you wish to cancel the entire order, you  will receive a credit note for the full purchased amount of the invoice,  valid for thirty-six (36) months or you may exchange any items on your  order for other item(s) of equal or greater value. Any additional items  to the order will be added with the current advertised price and may  attract further delivery fees. 

d. If you choose to terminate your standard purchase order before taking  possession and only if you do not want a store Credit or exchange then  you will be subject to a cancellation fee. The cancellation fee will be  calculated as thirty percent (30%) of the total initial purchase value of  the requested cancelled item as dated on the Tax Invoice. If you opt for  a refund, we will apply the Cancellation fee and return the remainder to  you via the same method of payment. A Cash Refund cannot be  returned if the method of payment was with Credit Voucher, Promotion  or Gift Card.

e. If you have received your items and have a change of mind, you have  the following option if the product is in its original unopened packaging  and it is within 7 days of you receiving goods:- we can accept the  product(s) back however a 30% cancellation fee will be applied to the  total of the items being returned should you opt for a refund and not a  store credit. Bookings for delivery returns for a change of mind are not  covered by Koala Living and must be prepaid in advance. This does  not apply to any goods that are defective – refer to our Warranty Policy  and the notation about the Australian Consumer Law.

f. Once you have received your items, regretfully Koala Living cannot  accept return of unboxed, assembled or used goods if you have  changed your mind or deemed you had no use for them. This includes if a 3rd party was engaged to assemble or remove the packaging on  your behalf. This does not apply to any goods that are defective – refer  to our Warranty Policy and the notation about the Australian Consumer  Law. 

Australian Consumer Law: If you are a consumer under the Australian Consumer Law, you have certain rights, including under the consumer guarantees. Nothing in this change of mind policy limits, excludes or modifies any rights you have that  cannot lawfully be limited, excluded or modified.

Terms & Conditions: 12 Days of Christmas Giveaway - Instagram
The contest is open to residents of Australia only. Participants must be 18 years or older at the time of entry. The competition ends at 11:59 pm AEST on the 28th of December 2023. The winner will be randomly selected from eligible entries. All winners will be announced on the 29th of December, on our Instagram page. If the winner does not respond within 7 days, a new winner will be selected. Due to festival season demands, prize delivery may take an extended period. The Prize can be changed without notice if the product is not available.

Please note that the product cannot be exchanged for credit or swapped. By entering, participants agree to allow us to use their Instagram handle and content for promotional purposes. This contest is in no way sponsored, endorsed, or administered by, or associated with Instagram. We reserve the right to modify, suspend, or terminate the contest at any time without notice. Participants agree to comply with all Instagram policies and regulations.
