CORRECTIVE NOTICE

Koala Living wishes to inform customers that statements made on its website between 26 April 2023 to 30 August 2024 were misleading or deceptive or likely to mislead or deceive in contravention of the Australian Consumer Law. Specifically, customers may have been misled or deceived about their consumer rights by the following statements:

1. Claims for goods with imperfections must be made to Koala Living within seventy-two (72) hours of delivery or collection, or otherwise manufacturing faults can be reported within the manufacturer warranty period.
This is incorrect. The Australian Consumer Law gives consumers a statutory right to a remedy for a failure to comply with a consumer guarantee. That right is not confined to any specific period imposed by Koala Living or the manufacturer’s warranty period.

2. Koala Living has the right to decide whether to provide a replacement, repair or other remedy in the event of faulty goods.
This is incorrect. Under the Australian Consumer Law, a consumer has the right to choose a remedy of a refund or replacement in the event of a major failure to comply with a consumer guarantee.

3. Delivery charges incurred when returning faulty goods are non-refundable.
This is incorrect. The Australian Consumer Law gives a statutory right to recover damages for any reasonably foreseeable loss or damage suffered by the consumer because of the failure to comply with a consumer guarantee, which could include delivery charges. This right cannot be excluded, restricted or modified by Koala Living.

Koala Living would like to sincerely apologise to any customers who may have been misled by this conduct.

Koala Living has removed these misleading statements from its website and in other material it has published. Koala Living’s commitments are outlined in a recent court enforceable undertaking accepted by the Australian Competition and Consumer Commission to resolve the matter, available here: https://www.accc.gov.au/public-registers/undertakings-registers/koala-tree-pty-ltd-trading-as-koala-living Under the undertaking, Koala Living is providing a compensation program for consumers who reported faulty goods to Koala Living and were advised of the seventy-two (72) hour time restriction.
